These terms and conditions govern the reservation services offered by IBAIA-IMMOBILIER.COM for short-term seasonal accommodation rentals located in Guadeloupe, Martinique, Saint-Martin, and Saint-Barthélemy.
Depending on the destination and property selected, IBAÏA IMMOBILIER acts either as a direct vendor or as a mandated reservation agent. Applicable conditions are specified in the relevant articles of these Terms & Conditions.
The rental may not be extended without the prior agreement of the owner or the agency. The renter declares on their honour that they do not exercise any rental profession and that the property is rented solely as temporary accommodation.
A. General provisions
Prices are quoted in euros inclusive of all applicable taxes, unless otherwise stated, and excluding processing fees.
The Renter undertakes to take possession of the property on the date set in the contract and to pay the balance no later than 30 days before that date. Should these conditions not be met, the agreement shall be deemed cancelled and the deposit retained by the Lessor.
B. Multi-currency display
For information purposes, prices may be displayed in foreign currency (including USD) on international versions of IBAIA-IMMOBILIER.COM. These amounts are indicative only, based on a periodically updated reference exchange rate.
Unless expressly stated otherwise in the booking confirmation, the contractual price is denominated in euros (EUR) only. The deposit is collected in euros by IBAÏA IMMOBILIER. IBAÏA IMMOBILIER shall not be held liable for exchange rate fluctuations.
C. Order confirmation
Any booking on IBAIA-IMMOBILIER.COM implies full acceptance of these Terms & Conditions. A summary will be sent to your email address.
The provisions of this article apply exclusively to villas in Saint-Martin (97150) managed on-site by SARL 100% Villas. In case of conflict with preceding articles, this article prevails.
A. Role of IBAÏA IMMOBILIER — Reservation Agent
For Saint-Martin villas, IBAÏA IMMOBILIER acts exclusively as a reservation agent. Its role is limited to:
presenting and marketing the property on its website,
receiving and confirming the availability of reservation requests,
connecting the Client with the local partner agency.
IBAÏA IMMOBILIER is not a party to the rental contract. No payment relating to the stay is collected directly by IBAÏA IMMOBILIER. IBAÏA IMMOBILIER receives a commission from the local agency.

SARL 100% Villas bears sole responsibility for the rental contract, payment collection, on-site management, and customer service.
C. Currency and payment
Saint-Martin villa rates are in USD. Euro prices on the website are indicative only. Payments are made by bank transfer directly to SARL 100% Villas:
30% deposit, due within 14 days of receiving the rental contract,
Balance of 70%, due no later than 60 days before arrival.
Only the USD amount on the rental contract issued by SARL 100% Villas is contractually binding. Failure to pay within deadlines results in automatic cancellation.
D. Reservation process
A request on IBAIA-IMMOBILIER.COM is a referral request, not a direct sale. IBAÏA IMMOBILIER confirms availability by email and forwards the Client's details to SARL 100% Villas, who sends the rental contract, damage deposit form, and payment instructions directly to the Client.
E. Cancellation conditions
Cancellation conditions are those of SARL 100% Villas as specified in the rental contract. They take precedence over IBAÏA IMMOBILIER's general cancellation policy (Article VIII).
F. Complaints and liability
Complaints must be addressed primarily to SARL 100% Villas: reservations@villasfwi.com. IBAÏA IMMOBILIER shall not be held liable for conditions of the stay, these being the exclusive responsibility of SARL 100% Villas.
A joint inventory and condition report shall be drawn up between the parties upon arrival and departure of the Renter.
Properties are offered as long as visible on IBAIA-IMMOBILIER.COM. If unavailable after booking, we will notify you by email and offer an alternative or a full cancellation.
The security deposit covers damage to the property, furniture, and consumables. Refunded within 4 days if no damage found, or within 1 month if damage is found, less repair costs. Options:
Credit card pre-authorisation at least 15 days before check-in (free of charge),
Swikly deposit management service (2% surcharge, no card block).
Applies to direct bookings with IBAÏA IMMOBILIER (excluding Saint-Martin villas — Article IV):
Cancellation > 120 days before arrival: deposit may be applied to another stay at the same villa within one year,
Cancellation ≥ 30 days before arrival: deposit retained by Owner, less IBAÏA commission,
Cancellation < 30 days before arrival: full rental amount due, paid to Owner less IBAÏA commission.
For properties marketed via maeva.com, travelski.com, locatour.com and related platforms:
The contract is concluded directly between the Client and MAEVA, who bears sole responsibility,
MAEVA's conditions prevail over these Terms & Conditions,
No payment should be made directly to IBAÏA IMMOBILIER for a MAEVA booking,
Complaints must be addressed to MAEVA customer service.
The Renter accepts the property as found. Furniture and fittings must not be damaged. Missing, damaged, or unusable items must be reimbursed or replaced.
Subletting and assignment of rights are strictly prohibited without the owner's express consent. Parties and gatherings are not permitted. The number of occupants may not exceed the contractual limit without prior agreement.
The Lessor undertakes to make the property available in accordance with its description and to fulfil all obligations arising from this agreement.
Unless otherwise agreed in writing, the property may be accessed from 17:00 on arrival day. On departure day, it must be vacated by 11:00.
The Renter must take out a comprehensive home insurance policy with a holiday-travel extension (theft, fire, water damage) and third-party liability towards neighbours.
In the event of non-payment or breach of any clause, the owner may require immediate termination. The Renter shall vacate upon a summary court order.
The agent is authorised to enter information into the agency's computer system.
Complaints regarding services provided directly by IBAÏA IMMOBILIER must be sent by registered letter to 36 rue de la Chapelle, Z.I. Jarry, 97122 Baie-Mahault, or by email to info@ibaia-immobilier.com, within 14 days of key return. For Saint-Martin villas, see Article IV-F.
IBAÏA IMMOBILIER's liability is limited to direct damages caused by its own errors, up to the maximum amount covered by its insurer.
For Saint-Martin villas (Article IV), its liability is strictly limited to the referral service. All liability for the execution of the stay rests exclusively with SARL 100% Villas.
All elements of IBAIA-IMMOBILIER.COM are the exclusive intellectual property of IBAÏA IMMOBILIER. Any reproduction or redistribution, even partial, is prohibited without prior written consent.
Data collected is used for reservation management and may be shared with execution partners, including SARL 100% Villas for Saint-Martin bookings. In accordance with French law of 6 January 1978, you have the right to access, correct, and object to your personal data.
Contracts and invoices are archived on a reliable medium in accordance with Article 1348 of the French Civil Code. Computerised records constitute proof of transactions between the parties.
These Terms & Conditions are governed by French law. French courts have exclusive jurisdiction, including for reservations for properties in Saint-Martin.
